Terms Of Engagement

01. AGREEMENT

These Terms are a contract between you and Clickswave Labs Private Limited, a company incorporated in India and based in Gujarat ("Clickswave", "we", "us"), which operates the Crossfyre platform ("Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Refund and Cancellation Policy. If you do not agree, do not use the Service.

02. ELIGIBILITY

You must be at least 18 years old and able to enter a binding contract. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms. You are responsible for all activity under your account and for keeping your credentials secret.

03. AUTHORIZED USE ONLY

CROSSFYRE is a professional offensive security platform for authorized penetration testing, vulnerability assessment, and red teaming.

By using the Service you certify that you have the legal right to scan and test every target you configure. Your use must also comply with our Acceptable Use Policy, which forms part of these Terms.

04. SUBSCRIPTIONS AND BILLING

Paid plans are billed in advance on a recurring basis (monthly, quarterly, or annual, as selected at checkout) through our payment provider, Razorpay. By subscribing you authorise us, or the applicable provider, to charge your chosen payment method for each renewal until you cancel. Prices are shown at checkout and exclude taxes unless stated; applicable taxes are added as required by law.

You can cancel at any time from your account, which stops future renewals. How refunds and service credits work is set out in our Refund and Cancellation Policy. We may change pricing on notice; changes apply from your next billing cycle. Crossfyre Credits are a prepaid, closed-loop balance for use inside the platform, and are non-refundable and non-withdrawable.

05. SERVICE AVAILABILITY

We work to keep Crossfyre available and reliable, but we provide it on a reasonable-efforts basis and do not guarantee that it will be uninterrupted, error-free, or available at any particular uptime level. The Service may be unavailable for maintenance, updates, or reasons outside our control.

If the Service is unusable because of downtime or a defect we are responsible for, your remedy is the service credit described in our Refund and Cancellation Policy: an extension of your subscription time and/or an increase in your usage limits or credits. That service credit is your sole and exclusive remedy for downtime.

06. NO GUARANTEE OF FINDINGS

Crossfyre helps you discover and test, but it does not guarantee results. Scans and reconnaissance may miss issues that exist, or report findings that turn out to be false, and coverage depends on your configuration, your targets, and factors outside our control. You are responsible for reviewing, validating, and acting on any output. The Service is a tool, not professional security advice, and does not replace your own judgement or a qualified assessment.

07. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are and remain the exclusive property of Clickswave Labs Private Limited and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You retain ownership of the data and findings you generate.

08. WARRANTIES AND LIABILITY

The Service is provided "as is" and "as available" without warranty of any kind, to the maximum extent permitted by law. We are not liable for:

• Service downtime or data loss.
• Unintended damage to target infrastructure.
• Legal consequences arising from your actions.

Except for liability that cannot be excluded under law, our total liability arising out of or relating to these Terms will not exceed the fees you paid to us for the Service in the 12 months before the claim. We are not liable for any indirect, incidental, special, or consequential loss.

09. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Clickswave Labs Private Limited and the people who work on the Service from and against any claim, demand, loss, liability, cost, or expense (including reasonable legal fees) arising out of or connected with: your use of the Service; any target you scan, probe, or test; your breach of these Terms or our Acceptable Use Policy; or your violation of any law or the rights of a third party. We may assume the defence of any matter subject to this section, and you agree to cooperate with us if we do.

10. SUSPENSION AND TERMINATION

We may suspend or terminate access to the Service without prior notice for breach of these Terms, non-payment, fraud, or any threat to the integrity or safety of our network or other users. You may stop using the Service and cancel your subscription at any time. Sections that by their nature should survive termination (including intellectual property, warranties and liability, indemnification, and governing law) will survive.

11. CHANGES TO THESE TERMS

We may update these Terms as the Service and the law evolve. When we make material changes, we will update the effective date above and, where the change significantly affects your rights, notify you by email or in the product. Changes take effect when posted. If you keep using the Service after a change takes effect, you accept the updated Terms; if you do not agree, stop using the Service and cancel.

12. GOVERNING LAW

These Terms are governed by the laws of India. Subject to any right you have under applicable consumer law, the courts in Gujarat, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
